Complaint or grievance mechanisms are a formalised mechanism that allows rights holders to seek resolution for human rights violations that they face, and for state and non-state actors to meaningfully and effectively respond to them.
The following are some of the ways that complaint mechanisms help to uphold human rights:
Accountability: Complaint mechanisms allow perpetrators to be held accountable for their discriminatory actions.
Identification of issues: Complaint mechanisms are a channel through which grievances can be formally expressed, whether they are against a state, a corporation, or other entities.
Early resolution and prevention: Providing a means for early identification of issues through complaint mechanisms can help in addressing grievances before they escalate into more serious violations.
Access to Justice: For many marginalised communities, the formal legal system can be inaccessible due to cost, complexity, time, and other barriers. Complaint mechanisms can offer a more accessible and expedient route to seeking redress.
Data Gathering and Trend Analysis: The information gathered through complaint mechanisms can be used to identify patterns of abuse or systemic problems, and can be channelled towards preventative efforts for policy change or other measures.
Trust-Building: An effective complaint mechanism can build trust between the government (or other entity) and the community or people it serves or affects.
Compliance with International Standards: Many UN treaties require entities to have effective complaint mechanisms in place as part of the adherence to international human rights standards.
